Terms of Service
Last updated:
These Terms of Service ("Terms") govern your access to and use of the Knit Infosys Email Marketing Tool (the "Service"). By creating an account or using the Service, you agree to these Terms. If you use the Service for an organization, you represent that you have authority to bind that organization.
1. Eligibility and Accounts
You must be legally able to enter into these Terms and provide accurate account information. You are responsible for keeping your credentials secure and for activity under your account. Notify Knit Infosys promptly if you suspect unauthorized access or a security incident involving your account.
2. Use of the Service
Subject to these Terms, Knit Infosys grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for your lawful business purposes. You are responsible for your users, campaigns, connected services, and compliance with laws and industry requirements that apply to your use.
3. Email Consent and Compliance
You must:
- Use only contact data you obtained lawfully and are authorized to use.
- Send messages only when you have a valid legal basis and any consent required by applicable law.
- Include accurate sender information and any legally required identification or disclosures.
- Provide and honor unsubscribe, opt-out, suppression, and privacy requests promptly.
- Comply with applicable anti-spam, privacy, marketing, telecommunications, and data-protection laws.
You are solely responsible for determining which requirements apply to your recipients and campaigns.
4. Prohibited Conduct
You may not use the Service to:
- Send spam, deceptive messages, phishing content, malware, or unlawful communications.
- Use purchased, scraped, harvested, or otherwise unauthorized contact lists.
- Harass, exploit, discriminate against, or harm any person.
- Infringe intellectual property, privacy, publicity, or other rights.
- Interfere with the Service, bypass security or usage restrictions, or probe for vulnerabilities.
- Reverse engineer or copy the Service except where applicable law expressly permits it.
- Use the Service in a manner that could damage Knit Infosys, our providers, or other users.
5. Your Content and Data
You retain your ownership rights in contact data, templates, messages, and other content you submit ("Customer Content"). You grant Knit Infosys a limited right to host, process, transmit, display, and otherwise use Customer Content only as necessary to provide, secure, support, and improve the Service and fulfill legal obligations. You represent that you have all rights and permissions needed for Customer Content and its use through the Service.
6. Knit Infosys Property
The Service, including its software, design, documentation, branding, and related intellectual property, belongs to Knit Infosys or its licensors. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
7. Third-Party Services
The Service may connect with SMTP, IMAP, webhook, analytics, and other third-party services. Your use of a third-party service is governed by that provider's terms and policies. Knit Infosys does not control and is not responsible for third-party services, their availability, or their handling of information.
8. Service Availability and Changes
We may maintain, update, modify, suspend, or discontinue features of the Service. We aim to provide a reliable Service but do not guarantee uninterrupted, error-free, or permanently available operation. We may set reasonable technical or usage limits to protect the Service and its users.
9. Suspension and Termination
You may stop using the Service at any time. We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, failed to address abusive activity, or if suspension is required to protect the Service or others. Where practical, we will provide notice and an opportunity to remedy the issue.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." Knit Infosys disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, Knit Infosys and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from or related to the Service. Liability that cannot legally be excluded or limited remains subject to applicable law.
12. Indemnity
To the extent permitted by law, you will defend and indemnify Knit Infosys and its affiliates, personnel, and providers against third-party claims, losses, and reasonable costs arising from your Customer Content, campaigns, violation of these Terms or applicable law, or infringement of another party's rights.
13. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms with a new "Last updated" date and provide additional notice when required. Continued use of the Service after the updated Terms take effect means you accept them.
14. General Terms
If a provision of these Terms is unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; Knit Infosys may assign them as part of a reorganization, merger, acquisition, or transfer of the Service.
15. Contact Us
For questions about these Terms, contact Knit Infosys through the support channel published in the Service or on our official website.
